TERMS AND CONDITIONS
1- Definition
- Consumer: A natural person who is not acting for purposes related to trade, business, craft, or profession, and who enters into a distance contract with House of Unique.
- Entrepreneur: House of Unique, a registered sole proprietorship (ZZP) established in the Netherlands and operating under the name House of Unique.
- Distance contract: Any agreement concluded between House of Unique and a consumer within the framework of an organized system for distance selling of products, using one or more means of remote communication (such as the website www.houseofunique.com).
- Right of withdrawal: The consumer’s right to withdraw from the agreement within a reflection period of 14 calendar days, as provided by Dutch and EU consumer law.
- Durable medium: Any instrument that enables the consumer or the entrepreneur to store information addressed personally to them in a way that allows future reference for a period adequate for the purposes of the information (such as email).

3- Applicability
- These General Terms and Conditions apply to all offers, orders, and distance contracts concluded with House of Unique through its online store or any other official sales channel.
- By placing an order, the consumer acknowledges and agrees to these Terms and Conditions.
- Any deviations or additional terms are only valid if expressly agreed in writing by House of Unique.
- In case of translations into other languages, the English version of these Terms and Conditions shall prevail, unless explicitly agreed otherwise.
- If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
4- The Offer
- All product listings, prices, and descriptions on the House of Unique website are presented with care and attention to detail. However, all offers are non-binding and subject to availability.
- House of Unique strives to describe and display its products as accurately as possible. Nevertheless, minor variations in color, material texture, or packaging may occur due to screen settings or production differences.
- Obvious mistakes or typographical errors in an offer do not bind House of Unique.
- Each offer includes clear information about the product features, pricing (including VAT for EU customers), delivery options, and the consumer’s right of withdrawal.
- House of Unique reserves the right to adjust prices, modify product details, or update availability without prior notice, provided such changes do not affect existing confirmed orders
5- The Agreement
- The agreement between the consumer and House of Unique is established once the consumer places an order through the official website, and House of Unique confirms the order via an automated email confirmation.
- If an order cannot be accepted, for example due to stock unavailability, technical issues, or suspected fraud, House of Unique reserves the right to cancel or decline the order. Any payments already made will be fully refunded.
- The consumer will receive a confirmation email containing the details of the purchase, the total amount paid, and a link to these Terms and Conditions.
- House of Unique retains the right to refuse or cancel any order if reasonable doubt exists regarding the accuracy of the order, the payment method, or the identity of the consumer.
- Once an order has been confirmed, it cannot be modified or canceled unless permitted under the conditions of the Right of Withdrawal (Article 6).
6- Right of Withdrawal
- he consumer has the right to withdraw from the agreement within 14 calendar days after receiving the product, without giving any reason.
- To exercise the right of withdrawal, the consumer must notify House of Unique in writing (for example, via email to info@houseofunique.com) within the reflection period.
- The consumer must return the item to House of Unique in its original condition and packaging, unused and undamaged, within 14 days after submitting the withdrawal request.
- The consumer is responsible for the cost of return shipping, unless otherwise stated by House of Unique.
- Upon receipt and inspection of the returned item, House of Unique will refund the purchase price (excluding shipping costs, if applicable) within 14 days using the same payment method used for the original transaction.
- If the returned product is damaged, incomplete, or shows signs of use beyond what is necessary to determine its nature and functioning, House of Unique reserves the right to deduct the reduction in value from the refund.
- The right of withdrawal applies only to consumers (B2C) and does not apply to business or commercial orders.
7- Exclusion of Right of Withdrawal
The right of withdrawal does not apply to the following categories of products and situations:
- Customized or personalized products — Items produced or assembled specifically according to the customer’s preferences (e.g. engraved, color-customized, or made-to-order products).
- Limited editions or unique art pieces — Items classified as collectible, limited production, or part of an art/design collaboration that cannot be reproduced.
- Products that cannot be returned for health or hygiene reasons — Such as skincare, fragrance, or personal-use items once unsealed.
- Digital content or gift cards — If the consumer has already gained access or used the code.
- Business or commercial purchases — Orders placed under a company name or VAT number.
- Products damaged or altered after delivery — Including items showing signs of use, modification, or incomplete packaging.
8- Prices
- All prices displayed on the House of Unique website are shown in euros (EUR) and include VAT (BTW) for customers within the European Union, unless otherwise stated.
- For orders delivered outside the EU, import duties, customs fees, or local taxes may apply. These costs are the responsibility of the customer and are not included in the displayed price.
- House of Unique reserves the right to adjust its prices at any time due to changes in supplier costs, exchange rates, or market conditions. Such adjustments do not affect confirmed orders.
- In the event of obvious typographical or system errors in price display, House of Unique is not obligated to fulfill the order at the incorrect price.
- Promotional prices, discount codes, and campaigns are valid only during the specified period and under the published conditions.
- All prices are presented transparently and include any mandatory recycling, environmental, or packaging contributions applicable under EU law.
9- Payment
- Payments for all orders must be made in advance through one of the secure payment methods available on the House of Unique website, including major credit/debit cards, or other methods offered at checkout.
- All payments are processed via secure and encrypted connections in accordance with European PSD2 payment security standards.
- Orders will be confirmed only after successful payment authorization. House of Unique reserves the right to delay or cancel an order if payment has not been received or verified.
- In the event of a refund, House of Unique will reimburse the amount using the same payment method used for the original transaction, unless otherwise agreed.
- Business customers (where applicable) may request an invoice containing VAT details by contacting info@houseofunique.com.
- Any costs resulting from chargebacks, failed payments, or incorrect payment information provided by the customer shall be borne by the customer.
10- Delivery
- House of Unique ships orders worldwide using reliable delivery partners such as PostNL, DHL, UPS, FedEx, or other professional carriers.
- All delivery times stated on the website are indicative and based on estimated carrier schedules. While we strive to deliver as quickly as possible, delays caused by logistics or customs processes cannot be guaranteed against.
- The risk of loss or damage transfers to the consumer once the product has been delivered to the specified address or collected by the customer.
- If a delivery cannot be completed due to an incorrect address provided by the customer, additional shipping costs for redelivery will be borne by the customer.
- In the event that an item is lost or damaged during shipment, House of Unique will investigate the matter with the carrier. Replacement or refund will be arranged in accordance with the outcome of that investigation.
- Orders shipped outside the European Union may be subject to customs inspections, import duties, or local taxes. These are the sole responsibility of the customer.
- Partial deliveries may occur if part of the order is temporarily unavailable. In such cases, the consumer will be informed without undue delay.
11- Warranty
- All House of Unique products are covered by a standard 1-year warranty against manufacturing defects, unless otherwise specified on the product page.
- The warranty applies only to products purchased directly from www.houseofunique.com or authorized resellers.
- The warranty covers defects in materials or workmanship that occur under normal and intended use.
- The warranty does not cover:
- Damage caused by misuse, accidents, falls, water, or improper handling;
- Normal wear and tear or aging of materials;
- Modifications, repairs, or alterations made by unauthorized parties. - In case of a defect, the consumer must notify House of Unique within a reasonable period after discovery, by emailing info@houseofunique.com, including the order number and description of the issue.
- Upon verification, House of Unique may offer repair, replacement, or refund — depending on the nature of the defect and product availability.
- Warranty claims do not affect the consumer’s statutory rights under Dutch and EU law.
12- Complaints & Disputes
- House of Unique aims to deliver a high-quality customer experience. If the consumer has any complaints regarding a product, order, or service, they may contact info@houseofunique.com.
- Complaints must be submitted within a reasonable time after the consumer discovers a problem, clearly describing the issue and including the order reference.
- House of Unique will acknowledge receipt of the complaint and provide a substantive response within 14 calendar days. If more time is needed, the consumer will be informed accordingly with an estimated resolution date.
- If a complaint cannot be resolved through mutual agreement, the consumer has the right to submit the dispute to:
- The European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/odr
- Or the Dutch Consumer Disputes Committee (Geschillencommissie Consumentenzaken) if applicable. - All agreements and disputes between the consumer and House of Unique are governed by Dutch law.
- In the event of translation differences, the English version of these Terms and Conditions shall prevail.
13- Privacy & Data Protection
- House of Unique processes personal data in compliance with the General Data Protection Regulation (GDPR) and other applicable privacy laws within the European Union.
- Personal data collected via the website (such as name, email, shipping address, payment information, and browsing behavior) is used solely for purposes related to order fulfillment, customer service, and website optimization.
- House of Unique does not sell or trade personal information to third parties.
- To ensure smooth operation of its online store and marketing activities, House of Unique may share data with carefully selected third-party service providers, including:
- E-commerce platform: Shopify
- Payment processors: Major credit card networks
- Logistics & delivery: DHL, PostNL, UPS, FedEx
- Analytics & advertising: Google, Meta (Facebook/Instagram), TikTok, Pinterest
- These third parties process data only on behalf of House of Unique and under strict confidentiality agreements.
- Consumers have the right to access, correct, or delete their personal data at any time by contacting info@houseofunique.com
- The full privacy policy, detailing cookies, tracking, and data retention, is available at www.houseofunique.com/privacy.
- In the event of a data breach, House of Unique will notify the relevant data protection authority (Autoriteit Persoonsgegevens) and affected users in accordance with GDPR requirements.
14- International Provisions
- House of Unique conducts international sales in accordance with applicable laws and consumer protection regulations in the European Union, including:
- The EU Consumer Rights Directive (2011/83/EU)
- The General Data Protection Regulation (GDPR – 2016/679)
- The Dutch Civil Code (Burgerlijk Wetboek) - For customers located in other regions, House of Unique strives to comply with relevant local e-commerce and data protection standards, including (where applicable):
- The UK Consumer Contracts Regulations
- The US/California Consumer Privacy Act (CCPA)
- The Canadian Personal Information Protection and Electronic Documents Act (PIPEDA) - Any import duties, customs fees, or local taxes arising from orders shipped outside the European Union are the sole responsibility of the customer.
- All agreements, offers, and disputes arising from international orders are governed by Dutch law, with Amsterdam, the Netherlands as the exclusive place of jurisdiction.
- The United Nations Convention on Contracts for the International Sale of Goods (CISG / Vienna Convention) is expressly excluded.
- In case of translation discrepancies, the English version of these Terms and Conditions shall prevail.
15- Final Provisions
- House of Unique reserves the right to amend or update these Terms and Conditions at any time, in response to legal, technical, or operational developments.
- The most recent and legally binding version of the Terms and Conditions is always available on www. houseofunique.com/pages/terms-and-conditions
- Any changes to these Terms and Conditions shall not affect previously confirmed orders.
- If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- No failure or delay by House of Unique in exercising any right under these Terms shall operate as a waiver of that right.
- These Terms and Conditions constitute the entire agreement between the consumer and House of Unique and supersede any prior verbal or written agreements.
